2014年《身心障礙者權利公約》透過《身心障礙者權利公約施行法》成為我國法律體系的一部分。該公約第12條「法律之前獲得平等承認」對國家課與保障法律能力平等行使義務,其中第一號一般性意見認為監護制度帶有替代決策之性質,違反公約意旨,並要求締約國以支持性決策協助本人自主行使其法律能力。本文深入研究身心障礙者權利公約第12條解釋,並搜集澳洲針對公約義務於法律能力自主法制的檢討與實踐作為我國之對照。本文發現澳洲能力自主法制並未符合公約的標準,但是仍有值得參照及反思之處。澳洲對於監護採取的最小限制原則及最後手段性解釋仍不符公約精神,但以本人意願優於客觀最佳利益、監護宣告及本人財產皆會受到定期審查,符合

CRPD課與締約國之義務。澳洲的維多利亞州亦增設了「支持性人身與財產管理」制度,與本人共同決策並得代理部分行為而不否定本人法律能力。另外,澳洲之人身管理重於財產管理;澳洲亦有公共倡議人作為障礙者人權倡議部門,對內與政府部門協作,對外向民眾傳遞資訊與促進溝通。其次,本研究整理我國行政、立法及司法部門對監護制度及支持制度的狀況及社會對於監護制度的態度,並綜合提出建議與結論。本文認為,為促進我國朝公約義務邁進,司法部門方面,法院應在判決中積極適用身心障礙者權利公約。立法方面,應淡化監護制度財產法性質,將我國行為能力與監護制度脫鉤,廢除受監護人無行為能力之明文。我國應參照澳洲法,細緻規定人身管理規範、

應增加監護與輔助制度適格性定期審查;修正使法院以當事人主觀最佳利益為判決標準,以促進對本人之自主尊重;增訂定期財產紀錄回報,適當財產監督;輔助制度同意權範圍應有彈性,且可適當賦予有共同決定性質的代理權。另外,政府可參照澳洲成立人權倡議部門。行政方面,本文整理信託、不動產預告登記與金融註記等支持制度,呈現監護制度外其他能發揮自主與保護衡平的選擇,以期更能促進弭平社會期待與需支持者對於法律能力制度的期望落差。
